K-webtoons are gaining huge popularity not only in Korea but also overseas. But behind the bright side of development, there was also a dark side. In 2013, the damage to the writers began to surface, with the platforms signing an unfair contract for both copyright and advertising revenue for new writers. In response, the ¡®Ministry of Culture, Sports and Tourism¡¯ enacted and announced six 'standard contracts forms for comics' in April 2015. However, even after the establishment of the standard contracts forms, unfair contract issues and unfair contract termination continued to occur, and the ¡®Korea Manhwa Contents Agency¡¯, along with the ¡®Ministry of Culture, Sports and Tourism¡¯, collected opinions to revise the standard contract in the field of cartoons and distributed the current 'Standard Contract Form for Comics (2019)'. There are six standard contracts forms for Comics : ¡®¨ç Publishing Contract, ¨è E-book Issue Contract, ¨é Webtoon Installment Contract, ¨ê Copyright Delegation Agreement, ¨ë Co-authored Contract, and ¨ì Work-For-Hire Agreement for Comics'. Despite these efforts, the lack of legislation still makes it difficult to find a clear law to embrace the webtoon industry, and it is questionable whether the current 'Standard Contract Form for Comics (2019)' can serve as a sufficient guide to the rapid growth of the industry and the emergence of new contract forms.Now it's been a year since the standard contract form became available. At this point, I will review the content of the standard contract form and discuss whether there is anything to modify or supplement, whether the wording of the contract conforms to the current law, and whether it is not lacking for the changed webtoon industry.

The shipbuilders in South Korea records tremendous loss of seven trillion Korean Won, not long after entering the offshore construction market, due to adopting FIDIC Silver book based contracts for their construction contracts. One of the causes of such huge loss is accounted for the belated contract studies of the builders which are carried out after contract disputes arise, while the EPC contract clauses delivers all the contract responsibilities of design, supply, and construction unto the shipbuilders.Firstly, reviews of the contract forms that are frequently used by the international shipbuilding and construction market are made and secondly, a look on the commercial backgrounds of the frequent adoption of unbalanced contract forms even with the unceasing criticism on such unbalanced contract structures is made. Thirdly, for the purpose of understanding such bias in offshore construction contracts, the comparison between the SAJ form of conventional shipbuilding and FIDIC form of international construction. Reviews on the differences between the two forms pertaining to design responsibilities prior to the construction, investigation processes in the midst of the construction, and duties in regard to the unexpected outbreak of problems. Fourthly, commercial and legal recommendation as a strategic solution against such bias in consideration of the international commercial market, requesting wholesome understanding on legal contract structures and commercial applications.

This study conducted interviews and surveys on the current status and problems of port transportation-related businesses such as lashing and rowing for the Busan New Port container terminal. The purpose was to develop a standard contract for the industry.In addition to interview and survey results of 18 representatives of port transport related companies, the main contents of standard contract for port transport related businesses are summarized as a result of analysis of previous studies in other fields such as publishing, R&D service, and performing arts. The standard contract derived as a result of this study reflects the position of the port transport-related businesses to some extent while at the same time trying to achieve a reasonable balance of profits between the shipping companies and the port transport-related businesses.As a result, it is expected that it will serve as a cornerstone for establishing fair practices in the industry and forming a trusting relationship between the two parties.

The development of high-speed information communication networks and the popular distribution of mobile devices have brought a huge structural change to the broadcasting and video industry, which is a representative one-man media content industry. The development and popular distribution of smart devices have reduced reliance on broadcasting production infrastructure such as cameras and studios, and the development of wide-area network technology has made it easier for anyone to produce and distribute video content without restrictions. The one-man media industry has emerged as a new professional group, called creators, as the opportunity to generate significant profits through platforms and the social status of content creators has increased. Anyone can easily participate due to low entry barriers, but as the size of the market grows and workers increase, quality growth of content has given rise to competition, and competition has limited content creators to generate profits on their own platforms, and difficulties such as copyright disputes and revenue-related tax management. This is a new type of business formed to see the possibility of online advertising market through MCN (Multi Channel Network) and to support creators at the same time to make profits. They receive part of their profits in return for supporting creators' content, and MCN is expected to play a pivotal role in the one-man media industry in terms of facilitating quantitative supply and quality of content, but conflicts are increasing as the market grows. However, there are currently no clear regulations on the legal nature of MCN contracts, and MCN businesses and creators are not subject to the Popular Culture and Arts Industry Development Act and the Artist Welfare Act. Therefore, this paper seeks to find out the legal properties of MCN contracts through understanding the structure and characteristics of MCN contracts, protect creators through research on the introduction of standard contracts in MCN industries, and promote sound development of the one-person media industry.

Adopting standard contractual clauses for pet sales can be a great way to ameliorate some of the problems related to pet sales. The main points of the standard contractual clauses are as follows: Firstly, it is required to include the scope of companion animals. It is desirable to specify dogs and cats. In addition, it is reasonable to judge individually whether an animal can be a 'companion animal' in the standard pet sales contract.Secondly, it is necessary to stipulate a duty to provide information. A seller shall deliver to the purchaser a written statement that includes breeder information, a record of inoculations, and the application for registration of any dog over the age of two months. It is appropriate to specify a list of core vaccinations taking into consideration the age of the companion animal in the contract.Thirdly, it is required to include a clause of the seller's liability for warranty against defect based on Article 580 of the Civil Act. The defect should be presumed if within 15 days after receipt of the animal by the purchaser, the animal has died of or suffers from disease except a congenital or hereditary one that existed in the animal on the date of the sale or if the seller does not notify the animal¡¯s congenital or hereditary condition to the purchaser. Furthermore, it is desirable to create a clause stating that the buyer has a right to demand the removal of a defect.Fourthly, it is appropriate to specify the content of non-performance of obligations and compensation for damages on the basis of Article 390 of the Civil Act. It is required to make it clear that the seller's liability for warranty against defect is concurrent with the liability for non-performance of contractual obligation.Fifthly, there is a need for rescission clauses. In addition, within 7 days after the date of sale, the purchaser shall have a right to rescind the contract if the seller does not provide a written contract.Lastly, it is desirable to include clauses that clarify a duty to deliver an animal or pay the purchase price, a ban on pet sales to minors, personal information protection, and governing law.
