본 고는 국제 장애인 권리조약의 이념적 토대와 논의 전
개과정을 고찰하면서 장애 개념에 대한 인권론적 담론을 제시하고 장애인 인권 조약의 특수한 과제와 의미를 밝히고자 한다. 국제 장애인 권리조약은 냉전시대에 인권을 국제화한 세계 인권선언에 대한 선언적 동의를 바탕으로 하고 있다. 또한 실무그룹의 초안문서는 1966년 유엔총회에서 채택한 \"경제적,사회적,문화적 권리에 대한 국제 규약(The Covenant on Economic Social and Cultural Rights)\" 과 \"시민적,정치적 권리에 대한 국제규약(The Covenant on Civil and Political Rights)\"의 내용을 핵심으로 하면서 장애인권의 특수성을 다루고 있다.
따라서 실무그룹 회의 및 Ad Hoc Committe
e 내용의 쟁점은 보편적 권리와 특수한 권리, 혹은 법적 구속력을 지니는 구체적 조약과 선언적 문헌이라는 양극의 대립 속에서 균형을 잡고 합의를 가져 나가는 과정이 되어가고 있다. 물론 양극의 대립이 항상 일정한 구도와 각을 갖고 있지는 않았다. 개도국과 개발국이 대립하기도 하고, NGO 와 GO가 의견의 차이를 가질 때도 있으며 때로는 장애 유형의 차이에 따라 보다 특수한 권리가 대두되기도 한다. 그러나 분명한 것은 세계인권선언이 그러했듯이 다양한 스펙트럼으로 지속되는 논쟁 속에서도 이 과정을통하여 장애인 인권의 기본적인 사각지대를 밝히고자 하는 기본정신을 잃지 않으려 한다는 사실이며 그것을 허락 치 않는 장애인 당사자의 저력과 힘이 회의장에 실재한다는 것이다.
이러한 흐름을 대 전제로 본 고에서는 국제 장애인 권
리조약의 추진과정을 최초의 국제협정 제안에서부터 고찰하고 전문과 조문의 핵심내용과 국제 장애인 인권 조약의 특수한 과제를 조망해 보고자 한다. 그 속에서 대두되는 쟁점은 장애인의 독립생활권, 장애인의 접근권, 장애인의 이동권 이며 바로 이것은 합리적 배려(reasonable accommodation) 라는 기본 이념을 중심으로 하는 장애인의 특수한 권리인 것이다. 그리고 우리에게 남겨진 차기 합의의 과제 중 하나는 여성장애인의 인권을 다루는 단독 조항의 제안이며 이 특수조항의 제안을 위한 국내외적인 준비작업이 요구된다 할 것이다.
이렇게 진행 중인 국제 장애인 권리조약은 장애 문제에
대한 기본적인 시각의 대 전환을 이루게 될 것이며 국내외적으로 일어나는 제도적 변화를 통해 더 이상 권리가 복지로 오해되는 일이 없이 장애인의 권리 신장을 보장하게 될 것이다.

This paper attempts to shed t
he light of human rights on the concept of disability and identify emerging issues and meanings of convention on the rights of disability. The ongoing convention associates its position with the International Declaration on Human Rights developed world-wide in cold war period. In addition, draft text of Working-Group under UN Ad Hoc Committee focuses on uniqueness of human right of disability with core ideas from \'the Covenant on Economic, Social and Cultural Rights\' and \'The Covenant on Civil and Political Rights\' adopted by UN General Assembly in 1966.
In sum, the negotiation pro
cess of Working-Group and Ad Hoc Committee meeting moves around the two extreme issues of universal versus specific rights and prescriptive or enforceable treaty versus declaratory document. It takes place sometimes between developing and developed countries, GOs and NGOs, and different types of disabilitys. However, it is important to note the fact that these negotiating processes maintain efforts not to lose the spirit of convention to protect the rights deprived of for a long period of time and persons with disabilities and their organizations persist the meetings not to stop throughout the meeting.
This paper also examines th
e content of the Draft of the convention from preamble to the end of articles with major attention on the areas specifically related to disability. These include right to independent living, right to accessibility and right to mobility, all of which would fall into the concept of reasonable accomodation. One of the major areas left for next Committee meeting is women with disabilities.
Finally, this paper argues
that such an ongoing convention will contribute to a turning point to understand disability issues from rights-based perspectives and to secure the enhancement of rights of persons with disabilities representing an evolution from welfare to rights.
